The final court decision was made, "Judicial settlement with the daycare"


Our 3 months old son was killed by Daycare.


In 2010, I dropped our baby to the daycare. 3 hours later I received phone call from the daycare worker and said they were at the hospital with my son because he wasn’t breathing.


When I arrived at the hospital, my baby was dead. The cause of death was bacterial pneumonia, told by the police


Few weeks later, unbelievable fact was unravelled, the daycare workers left my baby along with 12 other infants alone unattended by any adult and went to the Gym during the napping time, and they were hiding it until the testimony of an eyewitness told the police.


We felt something suspicious about the daycare, therefore we asked for legally autopsy, and the cause of death was not from bacterial pneumonia


The truth is, our baby was put facing down and was suffocated to death while they were at the Gym


We decided to bring a case and press charges against the daycare.

5 years of trial, we were convinced by the court and attorney that it is better to settle with the daycare. Of course we could never agree but after they told us how much it will cost us if we keep continue, it was almost like force decision.


Until today, the daycare hasn't given an apology nor condolence...

A baby was killed at the daycare where was unattended by any adult.

Our son Hirotake was born on 10/08/2009 which was exactly the expected date of birth.
He came out to this world with 2694 gram and was a healthy and fine looking baby.
My maternity leave from work was until 01/31/2010, therefore, we enrolled him for the daycare on the same day as when I started working on 02/01/2010

This Daycare had been running for 33 years, but they were non-authorized daycare ran by a Mother and a daughter, so called private mom and pop type of daycare.

On 02/01/2010 at 9:30AM, we first time took the Baby, Hirotake, to the daycare, and I told him “we will come pick you up in the afternoon” and I left for work.

After about 3 hours later, the owner lady called my cell phone and said, “your son was throwing up and we are at the hospital now, please come to the hospital ASAP”

When I arrived at the hospital and saw him, he looked a different baby from that morning when I left him at the daycare.
His face and legs were deadly pale. He was lying down on the Bed of the emergency room and getting life support.
When I saw a little Hirotake, I could not figure out what was going on, and then I became in panic.


The Doctor said, 
“The daycare lady came in with her car, without using ambulance, so I was also surprised to see her in panic, as soon as she came in with the baby, I immediately took X-ray and his pulse, but his heart had already stopped. I asked her how come she did not call the ambulance, she said she thought it was faster to take him to the hospital with her car than calling the ambulance.  According to her, her husband was a ex-paramedic, and she must be well aware of paramedic. I do not understand why she did not call the ambulance, the baby’s life might have been saved if she had called the ambulance.”


Few days later, after we investigated what really happened to our baby, we found out the fact that they not only put our baby, who still couldn’t flip turn, facing down, but also left other 12 infant babies alone, locked the door and went to a Fitness Club.  The daycare was totally unattended by any adult.
